1 General<\/strong>
1.1. In these terms and conditions, “Calma Clinic” refers to Calma Clinic, located at Rozengracht 42 D in Amsterdam, and its associated employees.
1.2. In these terms and conditions, “client\/patient” refers to the person who instructs Calma Clinic to provide treatment.
1.3. In these terms and conditions, “client\/patient” also refers to their legal representative.
1.4. These terms and conditions are part of every agreement between the client\/patient and Calma Clinic.
1.5. These terms and conditions also apply if Calma Clinic involves third parties in the execution of the assignment.
1.6. The operation of articles 7:404 and 7:407, paragraph 2 of the Dutch Civil Code is explicitly excluded.<\/p>

2 Agreement<\/strong>
2.1. The agreement between Calma Clinic and the client\/patient involves the assignment from the client\/patient to Calma Clinic for treatment.
2.2. Calma Clinic is entitled to refuse to act on an unreasonable request from the client\/patient and may refuse to perform a treatment.
2.3. Cancellation or suspension of the agreement is possible if the client\/patient behaves improperly or unfairly toward Calma Clinic, its employees, volunteers, other clients, or their visitors.
2.4. Packages have a expiration date of 1 year and 6 months from the date of purchase. After this period, any unused treatments will expire.<\/p>

3 Consent<\/strong>
3.1. The client grants unconditional and without reservation consent to the treatment agreement by filling in and signing Calma Clinic’s intake form prior to the execution of the treatment.
3.2. Calma Clinic may require the client\/patient to confirm their consent in writing.
3.3. The client grants unconditional and without reservation consent \u2013 considering due care \u2013 for the registration of their personal and medical data relevant to the treatment and the handling of the treatment.
3.4. If the client\/patient refuses or withdraws their consent, Calma Clinic will not perform any further treatment.<\/p>

4 Information<\/strong>
The client\/patient is required to promptly inform Calma Clinic of any information necessary for the proper execution of the agreement.<\/p>

5 Rates and Health Insurance<\/strong>
5.1. Rates apply, unless otherwise agreed in writing, for the duration of a calendar year and may be adjusted annually.
5.2. The client\/patient is responsible for ensuring they are aware of whether and to what extent their insurer covers the treatment. Furthermore, it is the responsibility of the client\/patient to submit invoices for reimbursement from their insurer.<\/p>

6 Payment<\/strong>
6.1. The client\/patient must pay immediately after the treatment, either in cash or by card.
6.2. If Calma Clinic treats the client on credit, the client must ensure full payment within 14 days, specifying the invoice number and type of treatment when transferring the amount to the appropriate account of Calma Clinic.
6.3. Regardless of whether the invoice is reimbursed by the insurer, the client\/patient is always obliged to pay the full invoice amount on time.
6.4. Payments are first applied to the oldest outstanding invoices.
6.5. If the client\/patient does not pay the invoice on time or in full, they are in default. Calma Clinic is then entitled to charge the legal interest on the invoice amount or the remaining balance. Calma Clinic is also entitled to take collection measures. The costs associated with collection (including extrajudicial costs and other expenses) will be borne by the client\/patient.
6.6. In case of payment arrears, Calma Clinic is entitled to suspend further treatment or only provide treatment on a direct and full payment basis.
6.7. The payment obligation is not suspended by the client\/patient filing a complaint with Calma Clinic regarding the invoice and\/or the treatment, unless Calma Clinic agrees to suspend the payment obligation.
6.8. The payment obligation does not expire if the client\/patient terminates the agreement.
6.9. Amounts already paid will not be refunded if the client\/patient is unable or unwilling to continue with the treatment. Similarly, there will be no refunds for unused treatment packages.<\/p>

7 Cancellation<\/strong>
7.1. If the client\/patient is unable to attend an appointment, they must cancel it with Calma Clinic no later than forty-eight (48) hours in advance.
7.2. If the client\/patient fails to cancel or fails to cancel on time, the staff may charge the full or partial treatment fee.
7.3. Appointments must be canceled by email or phone. Cancellation is recorded when Calma Clinic receives the cancellation. If the client wants to cancel by phone, it is the responsibility of the client. The unavailability of Calma Clinic by phone is not a valid reason for failing to cancel the appointment in time.
7.4. If you are more than 15 minutes late, Calma Clinic reserves the right to take the full treatment.<\/p>

8 Liability<\/strong>
8.1. If an event occurs during the treatment, including but not limited to the incomplete or untimely execution of a treatment, which leads to Calma Clinic’s liability, such liability is limited to the amount covered by Calma Clinic’s liability insurance. However, Calma Clinic is not liable if the client\/patient is in default with regard to any obligation toward Calma Clinic at the time the event occurs.
8.2. Calma Clinic does not guarantee the amount of hair reduction after treatment(s), nor the number of treatments required to achieve the desired hair reduction.
8.3. Calma Clinic is not liable for burns and\/or damage to the skin due to, including but not limited to, tattoos, piercings, moles, and\/or pigmentation spots.
8.4. Calma Clinic is not liable for (worsened) pigmentation on the skin after treatment(s).<\/p>

9 Complaints<\/strong>
9.1. In the event of dissatisfaction or a complaint from the client\/patient regarding the treatment by Calma Clinic, the client\/patient must notify Calma Clinic by email as soon as possible, within 48 hours. Calma Clinic and the client\/patient will then make efforts to reach a solution.<\/p>

10 Nullity<\/strong>
If any provision of these terms and conditions is void or voidable, the validity of the remaining provisions will not be affected.<\/p>

11 Applicable Law<\/strong>
The agreement between Calma Clinic and the client\/patient, as well as any further agreements made to execute it, is exclusively governed by Dutch law.<\/p>

12 Amendments<\/strong>
12.1. Calma Clinic reserves the right to change these terms and conditions at any time.
12.2. Changes will be communicated to the client\/patient in writing or electronically via the website (www.calmaclinic.nl) and will take effect one (1) month after the date of such communication, unless stated otherwise in the communication. If the client\/patient does not object to the change within one (1) month after the communication date, the client\/patient is deemed to have accepted the change.
